TERMS & CONDITIONS AND NON-DISCLOSURE AGREEMENT
Part A is entirely new and covers your membership, payment, cancellation and credit. Part B is your existing published document, with changed or added text highlighted. For solicitor review before publication.
These are the Terms and Conditions for "Tenth Circles", a curated membership for mothers at similar stages of motherhood, which extends The Tenth Method into everyday life.
THE TENTH is the trading name for "Tenth Circles" which is registered at the address 52 Ravenscroft Ave, London NW11 8AU ("CLIENT"; "we"; "us"; or "our"). The full name of the legal entity is THE TENTH CARE LIMITED, company number 15716371. You can contact us at info@tenthwellness.com.
Part A covers your membership: who can join, what you pay, how you cancel, and how Tenth Credit works. Part B covers confidentiality, conduct and safety within your Circle. Both apply to your membership. Our Privacy Policy explains how we handle your personal information.
PART A: YOUR MEMBERSHIP
1. Who can join
To join Tenth Circles you must be aged 18 or over and expecting a baby with a due date falling within the period we specify for the Circle you are applying to join.
Tenth Circles is delivered online. Our events and gatherings are held in London, and you are welcome at them wherever you live.
2. Applying and joining
You apply for membership by completing our application form. Completing the form does not create a contract between us.
We review every application and will tell you whether it has been accepted. A contract is formed only when you have confirmed your membership and made your first payment. We will then send you written confirmation, including a copy of these Terms.
We may decline an application, including where no Circle is available at your stage of pregnancy. Where we decline, we will not take payment
3. WHAT YOUR MEMBERSHIP INCLUDES
Your membership includes the benefits described on our website at the time you join. These currently include a place in a private Circle on WhatsApp with a small group of women at a similar stage of pregnancy, access to a Tenth midwife within that Circle, live sessions with specialist practitioners, guidance and resources for your stage, Tenth Credit as described at clause 10, a gift each trimester, offers from our partner brands and invitations to our events.
Tenth Circles is designed to sit alongside your existing maternity care. It does not replace your doctor, midwife or medical team. Clause 15 explains what our midwife and specialist practitioners provide.
We may make reasonable changes to the benefits included in your membership. Where a change is material, we will tell you in advance and you may cancel under clause 7 without penalty.
4. price and payment
Membership costs £45 per month.
This is an introductory price. It is held for as long as your membership continues without interruption. If your membership lapses and you rejoin later, the price then current will apply.
Your membership has a minimum term of three months, which corresponds to one trimester. By joining, you commit to three monthly payments.
Your first payment is taken when you confirm your membership and covers your first month of membership. After that, payment is taken on the 1st of each month.
When you join, you authorise us to store your payment card details and to charge that card for each monthly payment as it falls due. This is a continuous payment authority. It continues until your membership ends or you cancel under clause 7.
5. Renewal
After your minimum term, your membership continues on a rolling monthly basis at the same price, and payments continue to be taken on the 1st of each month, until you cancel.
We will remind you before each renewal.
6. Your right to cancel within 14 days
Because you buy your membership online, you have a legal right to cancel within 14 days, beginning the day after you confirm your membership and make your first payment.
If you cancel within those 14 days and your Circle has not yet begun, we will refund everything you have paid, within 14 days of you telling us.
If your Circle begins during your 14 days, because you joined within 14 days of the start date, you are asking us to begin your membership inside the cancellation period. If you then cancel within the 14 days, you will pay for the days of membership already provided and we will refund the balance within 14 days.
To cancel, email info@tenthwellness.com. Telling us before the 14 days end is enough, and you do not need to give a reason or complete a form.
This right applies when you first join. It does not apply again to each monthly renewal.
7. Cancelling after the first 14 days
After the first 14 days, you may cancel at the end of your minimum term or at the end of any month that follows it.
To cancel, tell us before the 25th of the month. Your membership will then end on the last day of that month and no further payment will be taken.
If you cancel during your minimum term, your membership and your payments continue until the end of that term.
When your membership ends you will be removed from your Circle. Clause 10 explains what happens to any Tenth Credit you hold.
8. When your baby arrives
Your membership ends at the end of the month in which your baby is born.
We will waive any remaining months of your minimum term and take no further payments. Your Tenth Credit is issued at that point, to put towards your recovery
9. If your pregnancy ends, or your circumstances change
We understand that a pregnancy may end, or your circumstances may change significantly, during your membership.
If this happens, please contact us at info@tenthwellness.com or speak to your Circle moderator. We will not ask you for reasons beyond what you are comfortable sharing.
Your membership will end as soon as you tell us, or be paused if you would prefer that. We will waive the remainder of your minimum term, take no further payments, and refund the unused part of the month you have already paid for, calculated by reference to the days remaining in that month.
Any Tenth Credit you have already received remains valid in accordance with clause 10.
10. Tenth Credit
You receive £50 of Tenth Credit each time you complete three months of membership. Credit accumulates, so the longer you remain a member, the more you hold.
If your baby arrives before you complete a three month period, we will still issue that credit when your baby is born.
Credit may be applied towards Method Sessions and at-home programmes. It may be used to cover up to 15% of the price of any eligible booking.
Credit may not be applied to your membership fee, and it may not be applied to our retreats. If you book a retreat while you are a member, we will instead include one complimentary Method Session, chosen for your stage.
Each amount of credit is valid for 12 months from the date it is issued. Credit is non-transferable, has no cash value and cannot be exchanged for money.
If your membership ends, you stop accruing credit from that date. Credit already issued remains valid until it expires.
11. Refunds
Except where these Terms say otherwise, or where you have a legal right to a refund, membership payments are not refundable.
You are entitled to a refund where you cancel under clause 6, where your pregnancy ends or your circumstances change under clause 9, where we change your membership materially and you cancel as a result, where we end your membership under clause 12 for a reason that is not your breach of these Terms, or where we have not provided our services with reasonable care and skill
12. Ending or suspending your membership
We may end or suspend your membership where:
● you breach these Terms;
● your conduct within your Circle causes or is likely to cause harm or distress to other members; or
● you no longer meet the requirements in clause 1.
Where we end your membership for any of those reasons, no refund is due and any unused Tenth Credit is forfeited.
Where we end your membership for any other reason, including where a Circle does not proceed or we discontinue it, we will refund any payment covering a period after your membership ends, and any Tenth Credit you hold remains valid until it expires.
We will tell you in writing why your membership is ending.
13. Changes to these Terms
We may change these Terms. Where a change affects your rights or what you pay, we will give you at least 30 days' notice in writing, and you may cancel under clause 7 before it takes effect.
14. Complaints, and the law that applies
If you are unhappy with any part of your membership, contact us at info@tenthwellness.com. We will acknowledge your complaint within five working days.
These Terms are governed by the law of England and Wales, and you may bring legal proceedings in the courts of England and Wales.
PART A: YOUR MEMBERSHIP
15. What our midwife and specialist practitioners provide
Our midwife and the specialist practitioners who take part in your Circle provide general information and guidance about pregnancy. You are welcome to ask our midwife anything. She can tell you whether something you are experiencing is commonly reported at your stage of pregnancy. Where it is not, or where it needs to be assessed properly, she will tell you to contact your own maternity team.
Our midwife does not diagnose, prescribe or treat, and does not give advice specific to your individual circumstances or medical history. She does not have access to your maternity records and is not part of the team responsible for your care.
The guidance provided within your Circle is general. Nothing shared in your Circle replaces the advice of the doctor, midwife or medical team responsible for your pregnancy.
Your Circle is not monitored around the clock and is not a route for urgent concerns. Our midwife checks in regularly and responds to messages during working hours. If you have an urgent concern about yourself or your baby, contact your maternity unit or triage line, your GP, or NHS 111. In an emergency, call 999.
16. What Stays in Tenth Circles
You agree that all information shared within our Tenth Circles community is confidential and must not be shared outside the group. This includes:
● Personal stories, experiences, and challenges shared by other mothers
● Photos, videos, or other media posted in the community
● Private details about other members or their children (names, locations, phone numbers, personal circumstances)
● Screenshots of conversations or individual messages
● Any sensitive or personal information discussed in group chats
17. Prohibited Actions
You explicitly agree that you will not:
● Take screenshots of conversations and share them outside of your Circle without explicit consent from all individuals featured
● Share, forward, or repeat information from your Circle in other groups, social media, or with non-members
● Discuss other members' personal information or stories outside of your Circle
● Use information learned in the community for commercial purposes or personal gain
● Identify or "out" other members in public forums or to mutual acquaintances without their permission
18. Exceptions
You may share information outside the community only when:
● You have received explicit written permission from the specific member(s) involved
● You are required to disclose information by law or to protect someone's immediate safety
● The information is about your own personal experience (not involving other members' details)
19. Your Responsibility
You agree to show up with a curious and open mindset, and actively contribute in a thoughtful way within your Circle.
You understand that:
● Once you share information in your Circle, other members will see it
● You should only share what you're comfortable with others knowing
● The Tenth cannot control what individual members do with information, but we take violations seriously and have escalation procedures in place
● You are responsible for maintaining confidentiality even after leaving the community
Because your Circle takes place on WhatsApp, anything you share is delivered to and stored on the devices of the other members of your Circle. Neither you nor we can remove it from their devices, including after you or they leave. This is why the confidentiality obligations in these Terms continue to apply to every member after they leave a Circle.
20. Mutual Respect
This community is built on mutual respect and trust. We ask you to treat others as you would want to be treated, keeping their stories and challenges private and sacred.
21. Child Safety
While we encourage you to share your experiences about motherhood, you:
● Agree to never disclose identifying information about other members' children without explicit consent
● Understand that child safety concerns may need to be reported to appropriate authorities
22. Member Safety & Wellbeing
Participation in this community is voluntary and at your own discretion. You acknowledge and agree that you remain solely responsible for your own health, wellbeing, and any decisions or actions you take. The organisers, administrators, and members of this community accept no responsibility or liability for reliance placed on any content shared within the group.
If you are experiencing significant mental or physical health difficulties, including thoughts of self-harm, or are in distress or crisis, you must seek appropriate professional support immediately. In the UK, this may include contacting your GP, NHS 111, your local NHS mental health services, or emergency services by calling 999.
You understand and agree that we may intervene if we become aware of content suggesting you or another member may be at risk of harm (including self-harm, suicide, severe mental health crisis, domestic abuse, or child safety concerns).
Confidentiality has limits when safety is at risk. We reserve the right to:
● Contact you directly to check on your wellbeing
● Contact emergency services (999) if we believe someone is in imminent danger
● Report safeguarding concerns to appropriate authorities when legally required
23. Limitation of Liability
The Tenth acts exclusively as a provider and facilitator of the WhatsApp Tenth Circles community and does not assume responsibility for any medical advice or information shared by its practitioners.
We assume no liability for the accuracy, completeness, or usefulness of any information provided by practitioners or other users.
Any medical advice, recommendations, diagnoses, or treatment suggestions provided through Tenth Circles are offered solely by individual practitioners who participate in the community.
Practitioners participating in Tenth Circles maintain their own professional liability and are responsible for their own licensing, insurance and regulatory requirements.
We bear no responsibility for any outcomes, damages, or consequences arising from reliance on information obtained through Tenth Circles.
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for failing to provide our services with reasonable care and skill.
This community is not equipped to assess, manage, or respond to safeguarding concerns involving adults or children. If you have concerns about the safety or welfare of a child or vulnerable adult, you are responsible for contacting the appropriate authorities or professionals without delay, including your GP, health visitor, midwife, local authority children's services, or the police where there is an immediate risk of harm.
24. Consequences of Breach
Violation of these Terms and Conditions may result in:
● Immediate removal from Tenth Circles
● Potential legal action if the breach causes harm or distress
● Reporting to relevant authorities if the breach involves child safety concerns
Clause 12 sets out the grounds on which we may end or suspend your membership, and what happens to your payments and any Tenth Credit if we do.
